NextExec PRIVACY POLICY

Effective Date: 24 November 2020

Welcome to NextExec, a service provided by Brand Executives, Inc.

Please read this End User License Agreement carefully before clicking the “I Agree” button, downloading or using the NextExec system, website, or application. This Privacy Policy (“Policy”) along with the End User License Agreement, are a binding agreement between You the “End User” and Brand Executives, Inc (“NextExec,” Us, or “We”).

This Policy governs your use of the website, mobile applications and services that link to this Policy. In this Policy, the words “Sites,” “Websites,” “Apps,” and “Applications” refer to each of these websites and applications and the services offered through the NextExec Mobile Application (iOS, Android) and the NextExec website. The End User automatically agrees to this Policy and to our End User License Agreement simply by using or logging into the Next Exec Mobile Application or using the NextExec website.

Your use of NextExec services are provided by Us by enrolling through the NextExec website or mobile application.

1. The Information We Collect About End Users

We collect information about End Users directly from End Users and from third parties, as well as automatically, through your use of the NextExec website and mobile application.

Information NextExec Collects from You the End User:

We collect information from End Users when the End User contact us, registers with the NextExec website or mobile application, or otherwise utilizes the NextExec website or application. The type of information that we collect varies based on your interaction with us and may include: your name, email address, password, and phone number, and, if End User enters notes or sales information, any records entered into the NextExec mobile application or website.

Information NextExec Collects Automatically.

We automatically collect information about your use of our Website through cookies, web beacons, and other technologies, including the following:

  • Your browser type and operating system.
    • Web pages End User view; links you click; your IP address.
    • The length of time you visit our website or are active on the mobile application
    • The referring URL or the webpage that led the End User to our Site

We combine this information with other information we collect about End Users as well as use this information to identify End Users across your multiple devices. Please see the section “Cookies and Other Tracking Mechanisms” below for more information.

2. How NextExec Uses Your Information

We use your information, including your personal information, for the following purposes, and as otherwise permitted by law:

  • To provide our services to you, to communicate with the End User about your use of our services and to respond to support inquiries or send notifications
  • To tailor the content and information that we may send or display to you, to offer personalized help and instructions, and to otherwise personalize your experiences while using the NextExec mobile application or website
  • For marketing and promotional purposes. We may contact End Users for the purposes of User Management or technical support using contact information provided by the End User
  • To better understand how users access and use the NextExec mobile application and website, both on an aggregated and individualized basis.
  • To evaluate, improve, or modify our Website.
  • For research and analytical purposes.
  • To send push notifications
  • To comply with applicable legal obligations, including responding to a subpoena or court order.
  • For other business-related purposes including termination of, or updates to NextExec services
  • To protect us and others.
3. How We Share Your Information

We may share your information, including personal information, as follows:

Affiliates.

We may disclose the information we collect from End User to our affiliates or subsidiaries; however, if we do so, their use and disclosure of your personal information will be subject to this Policy.

Service Providers.

We may disclose the information we collect from End User to third-party vendors, service providers, contractors or agents who perform functions on our behalf. For example, we share your information, both on an individual basis or in the aggregate, with third parties to assist us in improving our products and services and to assist us in determining relevant services. These third parties may include entities that assist us and other companies with communicating with End User and serving and advertising to you, including advertisements on third-party websites, social media platforms, as well as through push notifications and email. We do not, however, share your personal information with third parties for marketing purposes.
We may also share information in the following circumstances:

Business Transfers.

If we are acquired by or merged with another company, if some or all of our assets are transferred to another company, or as part of a bankruptcy proceeding, we may transfer the information we have collected from End User to the other company. End User will be notified prior to the transfer date and may choose to opt out prior to the completion date of any Business transfer.

In Response to Legal Process.

We also may disclose the information we collect from End User in order to comply with the law, a judicial proceeding, court order, or other legal process, such as in response to a court order or a subpoena.

To Protect Us and Others.

We also may disclose the information we collect from End User where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms and Conditions or of this Policy, or as evidence in litigation in which We are involved.

Aggregate and De-Identified Information.

We may share aggregate or de-identified information about users with third parties for marketing, advertising, research or similar purposes.

4. Our Use of Cookies and Other Tracking Mechanisms

We and our third-party service providers use cookies and other tracking mechanisms to track information about your use of the NextExec mobile application an Next Exec website. We may combine this information with other personal information we collect from End User (and our third-party service providers may do so on our behalf).

Cookies.

Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for End User to navigate the Next Exec Website and Application, while others are used to enable a faster log-in process or to allow us to track your activities at our Website.

Disabling Cookies.

Most web browsers automatically accept cookies, but if End User prefers, End Users can edit your browser options to block them in the future when accessing the NextExec desktop site. The NextExec mobile site may contain cookies that cannot be deactivated and are governed by the applicable App Stores as designated by the Apple AppStore or Google Play Store. The help portion of the toolbar on most browsers will tell End User how to prevent your computer from accepting new cookies, how to have the browser notify End User when End User receives a new cookie, or how to disable cookies altogether. Visitors to the NextExec Website who disable cookies will be able to browse certain areas of the NextExec Website, but some features may not function.

Cross Device Use.

We may use the information that we collect about the End User(whether directly from the End User from our website, mobile application or through your device(s), or from a third-party) to help us and our third-party service providers identify other devices that the  End User uses (e.g., a mobile phone, tablet, other computer, etc.). We, and our third-party service providers, also may use the cross-device tracking and other information we learn about the End User to serve targeted notifications, to send the End User push notifications, and to send End User emails. Please note: if End User opts-out of these targeted advertising cookies, your opt-out will be specific to the web browser or mobile device from which the End User accessed the opt-out. If End User uses multiple devices or browsers or NextExec applications, the End User will need to opt-out each browser or device that End User utilizes.

Location Services

Location Services allow the NextExec app and website to gather and use End User location information based on the current location of the End User’s device to provide a variety of location-based services. End User location data will be used to provide push notifications within specific geofences. Location data is not shared with third party applications and is not used for marketing purposes. In order to use location features, the End User must enable Location Services on the End User’s device and give their permission to the NextExec app before it can use the End User’s location data. NextExec may request limited access to End User location data (only when the End User is using the app or approximate location) or full access (even when the End User is not using the app or precise location). Location Services use GPS and Bluetooth (where those are available) along with crowd-sourced Wi-Fi hotspot and cell tower locations to determine your device’s approximate location. The End User can disable Location Services on their device to the extent that the manufacturer allows these services to be disabled. Please consult the device user manual for instructions on disabling location services.

Children’s Privacy

Our Service is not directed to individuals under the age of 18. We do not knowingly collect or use any personal data from users under 18 years of age. No information should be submitted to our website from visitors under 18 years of age. End Users must be 18 years or older to purchase and/or use our Service. If we learn that we have collected personal data from someone under 18, we will take steps to delete the information as soon as possible.

Third-party Analytics.

We use automated devices and applications, such as Google Analytics, to evaluate usage of our Website. We use these tools to help us improve our Services, performance, and user experiences. These entities may use cookies and other tracking technologies to perform their services.

Do-Not-Track (“DNT”).

There is no industry do-not-track standard, therefore We do not make any guarantee that we will honor DNT signals. The Help portion of the toolbar on most browsers will tell End Users how to use your web browser’s do-not-track feature. Please be advised that we cannot guarantee that our processes will capture all such do-not-track signals. The End User also may disable certain tracking as discussed in this section (e.g., by disabling cookies); End Users may opt-out of targeted advertising by following the instructions in the Third-party Ad Network section.

5. Third-Party Links

Our Website may contain links to third-party websites. Any access to and use of such linked websites is not governed by this Policy, but instead is governed by the privacy policies of those third-party websites. We are not responsible for the information practices of such third-party websites.

6. Security of My Personal Information

We have implemented commercially reasonable precautions to protect the information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware that despite these measures, no data security measures can guarantee security.

The. End User should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

7. Access to My Personal Information

An End User may modify personal information that the End User have submitted by logging into your account and updating your profile information. Please note that copies of information that you have updated, modified or deleted may remain viewable in cached and archived pages of the NextExec website or application for a period of time. An end user may request to have this information permanently removed and NextExec and the Brand Executives, Inc will determine whether this information will be deleted in accordance with applicable governing laws.

8. What Choices Do I Have Regarding Promotional Emails?

NextExec may send periodic promotional emails to you. The End User may opt-out of our promotional communications by following the opt-out instructions contained in the email. Please note that it may take up to 10 business days for NextExec to process opt-out requests. If the End User opts-out of receiving promotional emails about recommendations or other information we think may interest you, we may still send emails about your account or any Services the End User has requested or received from us.

10. Changes to this Policy

This Policy is current as of the Effective Date 6 February 2020 at 11:59PM Eastern Standard Time. We may change this Policy from time to time, so please be sure to check back periodically. We will post any changes to this Policy on the NextExec website and mobile application. If we make any changes to the NextExec Privacy Policy that materially affect our practices with regard to the personal information we have previously collected from you, we will endeavor to provide End User with notice in advance of such change by highlighting the change on the NextExec Website and mobile applications.
